OnePlus Nord 2 blast case: Company sends cease and desist letter to lawyer whose Nord 2 exploded

Highlights
  • OnePlus has sent a cease and desist letter to Gaurav Gulati over the OnePlus Nord 2 explosion.
  • The company claims Gaurav’s tweets were a “malicious mala fide intent to harm OnePlus’s goodwill and reputation.”
  • OnePlus is seeking an unconditional apology and desist from making any demeaning statements about it.

A OnePlus Nord 2 customer, Gaurav Gulati, earlier this month claimed that his OnePlus Nord 2 caught fire and exploded. The company reached out to the victim and offered compensation but Gaurav rejected the offer and reportedly filed a complaint to the consumer court and ask the authorities to stop the sales of the OnePlus Nord 2 in India. While we’re waiting to hear an update in this regard, Mobitech Creation Pvt. Ltd, which is handling the marketing and sales of OnePlus phones in India has sent a cease and desist letter to Gaurav Gulati for posting misleading tweets and “malicious mala fide intent to harm OnePlus’s goodwill and reputation.”

The legal notice states that OnePlus has noticed a series of disparaging tweets from Gaurav Gulati on September 8th, 9th, and 11th, which are apparently “retributory, speculative, suggestive of a smear campaign to defame our client (OnePlus).” Additionally, Mobitech Creation feels the statements given by Gaurav to MySmartPrice, Gadgets 360, Notebook Check are unverified and self-contradictory in nature and are aimed at damaging the reputation of the company’s goodwill in India. Furthermore, the company says from the images shared on Twitter suggest the damage appears to have been caused due to external force to the battery pole.

Notably, Gaurav Gulati refused any assistance from OnePlus and verify the authenticity of the incident. The buyer even rejected the company’s request to get the device examined by an executive, which according to Mobitech Creation is misleading and is intended to defame the reputation. For all these reasons, the notice says that OnePlus is entitled to initiate appropriate legal proceedings against Gaurav for the malicious negative propaganda.

The notice demands that Gaurav Gulati responds with a confirmation, ceasing from making any demeaning statements about OnePlus, remove tweets/posts against the brand and issue a statement to media and OnePlus that the statements made till this point were unverified. Additionally, Mobitech is also seeking an unconditional apology and a confirmation to not post any further tweets that will damage OnePlus’s reputation.

Gaurav Gulati hasn’t mentioned his future course of action but condemned the legal notice sent to him.
